1. Acceptance of Terms

2. Description of Services

San Tan Valley Concrete provides residential and commercial concrete services in San Tan Valley, AZ and surrounding areas. Services include but are not limited to:

• Concrete driveways, patios, sidewalks, and pool decks
• Stamped and decorative concrete
• Garage floor concrete and interior floor installation
• Concrete retaining walls and steps
• Slab foundations, footings, and foundation work
• Concrete parking lots and commercial flatwork
• Concrete cutting

Availability of specific services may vary based on project location, scope, and current scheduling. We reserve the right to decline any project at our discretion.

3. Estimates and Pricing

All estimates provided by San Tan Valley Concrete are based on information available at the time of the site visit and are subject to the following conditions:

• Estimates are not final until a written contract or agreement is signed by both parties.
• Estimates may change if the scope of work changes, unforeseen site conditions are discovered, or material costs change significantly before project start.
• Any changes to project scope after a contract is signed will be handled through a written change order. Work on scope changes will not begin until the change order is agreed to by both parties.
• Estimates are valid for 30 days from the date provided unless otherwise stated in writing.

4. Scheduling and Cancellation

Project start dates are scheduled based on crew availability, permit timelines, weather, and material lead times. Start dates are estimates and are not guaranteed.

Customer cancellation

If you need to cancel or postpone a project, please notify us as soon as possible. Deposits paid to cover materials or permit fees already incurred may be non-refundable. The specific terms of your deposit and cancellation policy will be outlined in your written agreement.

Contractor cancellation

We reserve the right to postpone or cancel work due to severe weather, unsafe site conditions, permit delays, or other factors outside our control. In such cases, we will work with you to reschedule as soon as practicable.

5. Payment Terms

Payment terms are established in the written project agreement. General terms are as follows:

• A deposit may be required before work begins. The deposit amount will be stated in the written agreement.
• Final payment is due upon project completion unless otherwise agreed in writing.
• Accepted payment methods will be specified in the project agreement.
• Unpaid balances past 30 days from the invoice date may be subject to a late fee as described in the project agreement.
• Failure to pay may result in the filing of a mechanic's lien against the property in accordance with Arizona law.

6. Permits and HOA Approvals

Where required, San Tan Valley Concrete will apply for necessary permits through Pinal County Development Services or the applicable jurisdiction. Permit fees are typically passed through to the customer and will be itemized in the written agreement.

Customers in HOA communities are responsible for obtaining any required HOA approvals before work begins. We will assist with the process where possible, but delays caused by HOA review are outside our control and may affect the project start date.

7. Warranty Disclaimers

We stand behind our workmanship. Any warranty on labor or materials will be described specifically in the written project agreement.

The following are expressly excluded from any warranty:

• Normal hairline cracking in concrete caused by natural curing, temperature changes, or soil movement. Some cracking in concrete is normal and expected.
• Damage caused by misuse, modification, or work performed by others after project completion.
• Damage caused by acts of God, flooding, extreme weather events, or ground movement beyond normal settling.
• Issues resulting from pre-existing site conditions that were disclosed or reasonably discoverable at the time of estimate.

Except as expressly stated in a written warranty, all services are provided "as is" without any further warranty, express or implied.

8. Limitation of Liability

To the fullest extent permitted by law, San Tan Valley Concrete and its owners, employees, and subcontractors shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from or related to our services or your use of this website.
• Loss of use, lost profits, or damage to property not directly caused by our negligence.
• Damages exceeding the total amount paid by you for the specific project giving rise to the claim.

Some states do not allow limitations on certain warranties or liability, so some of the above limitations may not apply to you.

9. Website Use

You agree to use the San Tan Valley Concrete website only for lawful purposes and in a way that does not infringe on the rights of others. You may not:

• Use the website to transmit spam, malware, or any harmful content.

10. Dispute Resolution

If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in Pinal County, Arizona, in accordance with the rules of the American Arbitration Association, unless both parties agree in writing to another method of resolution. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

11. Governing Law

These terms and any disputes arising from them shall be governed by and interpreted in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Pinal County, Arizona.

12. Modifications to These Terms

We may update these terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of our website or services after any changes means you accept the updated terms. We recommend reviewing these terms periodically.
